Governing Law and Venue

This Agreement shall be interpreted, construed and governed by the laws of the Province of Alberta, without reference to its laws relating to conflicts of law and not including the provisions of the 1980 United Nations Convention on Contracts for the International Sale of Goods. Venue for all disputes arising under this Agreement shall lie exclusively in the Court of Queen's Bench for the Province of Alberta. Notwithstanding the foregoing, however, CNOOC shall have the right to commence and prosecute any legal or equitable action or proceeding before any non-US court of competent jurisdiction to obtain injunctive or other relief in the event that, in the opinion of CNOOC, such action is necessary or desirable.

No Waiver, Severability

No action of CNOOC, other than an express written waiver or amendment, may be construed as a waiver or amendment of any of these Terms and Conditions of Use. Should any clause of these Terms and Conditions of Use be found unenforceable, wherever possible this will not affect any other clause and each will remain in full force and effect. We reserve the right to change these Terms and Conditions of Use prices, information and available contractual license terms featured on this website without notice. These conditions set out the entire agreement between CNOOC and you relating to your use of this website.

Rules of Use

  • Editorial Use Only. CNOOC products made available on the cnoocintlphotos.com website may be published for editorial use only, in hardcopy, electronic or in broadcast format, provided that credit is conspicuously provided to “CNOOC International” on all such products as set forth below. For purposes of these Usage Rules, “editorial use” is limited to a publication relating to a newsworthy event, or which is otherwise in the public interest.
  • Attribution Rules. All CNOOC products published or otherwise used pursuant to these Usage Rules must be attributed to CNOOC as follows:
    • For print, presentation and Web materials:
      Credit to CNOOC International must appear next to or beneath the photo.
    • For broadcast: Credit to CNOOC International must appear on-screen throughout the entire air-time of the product. Additionally, if the products are referenced verbally during the program, they must be verbally attributed to CNOOC International
  • No Commercial Use. Except for the limited rights set forth in these Usage Rules, CNOOC retains all rights to the CNOOC products, and any commercial, promotional or other use requires the express written consent of CNOOC
  • No Alteration. No image published or otherwise used pursuant to these Usage Rules may be modified, altered or supplemented in any way without the express written consent of CNOOC, Inc.
  • Limited Grant of Rights. The rights provided in these Usage Rules by CNOOC may be revoked at any time by written notice of CNOOC.
  • PERMITTED USAGE
    • In digital format on non-commercial websites, multimedia presentations, broadcast film and video, cell phones.
    • In printed non-commercial materials, magazines, newspapers, books, brochures, flyers, CD/DVD covers, etc.
    • To decorate your home, your office or any public place.
  • UNAUTHORIZED USAGE
    • For pornographic, unlawful or other immoral purposes, for spreading hate or discrimination, or to defame or victimize other people, societies, cultures.
    • To endorse products and services.
    • In a disparaging manner to CNOOC or the person(s) depicted on the Image.
    • As part of a trademark, service mark or logo.
    • In website templates that you intend to sell or distribute.
    • For creating printed reproductions that you intend to sell.
    • On ”print on demand” items such as t-shirts, postcards, mouse pads, mugs (e.g. on sites like Cafepress), or on any similar mass produced item that would contain the Image in a dominant way.
